A legislator wants PEA to be in charge of kasambahay operations.

As part of his motion to alter Republic Act No. 10381, often known as the “Domestic Workers Act,” which he wrote ten years ago, Senator Jinggoy Estrada wants Private Employment Agencies (PEA) to be accountable for any conduct of their referred “kasambahays” or home assistants.

Estrada said that his Senate Bill No. 456โ€”also known as “An Act placing greater duty and accountability on private employment agencies (PEA)”โ€”would protect employers and their families from domestic employees with “criminal minds.”

Despite the benefits for the kasambahays, he stated in his statement, “there is a need to provide comparable protection to their employers given that the nature and location of their job are so intimate to the latter (employers)”.

According to his proposal, it is the obligation of the PEAs to make sure that the domestic assistant recruited and referred to employers has no criminal history and that there is enough information, such as a legitimately fide address and family history.

Additionally, they must obtain birth certificates, and clearances from the barangay, police, and National Bureau of Investigation (NBI).

In addition, Estrada added a subsection to Section 36 of his draft legislation, which states that PEAs are not responsible for any crimes committed by domestic helpers during their first year of employment and that responsibility ends a year after the domestic worker begins working for the employer.
