On Tuesday, Remulla met with representatives of the Supreme Court to talk about potential changes to the legal system.

The Department of Justice (DOJ) published new rules for prosecutors on Monday, lowering the suggested bond in criminal cases for short-term freedom for the needy to PHP10,000.

In accordance with Department Circular O11, the prosecution may only set the bond at PHP10,000 or 50% of the recommended bail amount as mentioned in the 2018 Bail Bond Guidance in cases involving poor defendants.

The DOJ claimed that the action and Department Circular 008-A’s prior directive to limit criminal cases to those with solid evidence supporting them would “decongest court dockets.”

The new rule is applicable to every case involving an inquest or preliminary examination of an indigent person, provided that the crime is not one that is punishable by death, reclusion in perpetuity, or life in prison.

The lower bail is intended to keep people out of jail who can actually post bail but cannot afford the sum set by the court.

The policy was introduced due to last month’s Justice Sector Coordinating Council (JSCC) discourse, which covered topics such as the overcrowding and overuse of jail and detention facilities.

Several of the issues the Bureau of Prisons is currently dealing with, like corruption, drug smuggling, and inmate entitlement, were brought on by the 330 percent congestion rate in the New Bilibid Prison in Muntinlupa.
