“No work, no pay” on the holiday of February 24: DOLE

Employees who choose to avoid work on Friday will be subject to the “no work, no pay” policy.

The Department of Labor and Employment (DOLE) released Labor Advice 82 after Malacaang declared February 24 to be a special non-working day, which is what this is based on.

According to the advice, dated Feb. 23, which was made public on Friday morning, “If the employee does not work, the ‘no work, no pay’ principle shall apply unless there is a favorable corporate policy, practice, or collective bargaining agreement.”

Employees who arrive at work on time, however, are entitled to overtime pay.

“The employer shall pay the employee an additional 30% of the basic wage on the first eight hours of work (basic wage x 130%) for work performed during the special day,” the DOLE stated.

It continued, “The employer shall pay the employee an additional 30% of the hourly rate on said day (hourly rate of the basic salary x 130% x 130% x number of hours worked) for work performed in excess of eight hours.

On the other hand, “the employer shall pay the employee an additional 50% of the basic wage on the first eight hours of work (basic wage x 150%)” if the employee worked on a special day that also fell on their rest day.

“The employer shall pay the employee an additional 30% of the hourly rate on said day (hourly rate of the basic salary 150% 130% number of hours worked) for work done in excess of eight hours on the special day that also occurs on the employee’s rest day,” the DOLE noted.

In instead of February 25, which is a Saturday, President Ferdinand R. Marcos Jr. stated Thursday that February 24 would be a special non-working day in honor of the EDSA People Power Revolution’s 37th anniversary.

According to the proclamation, the proposal is founded on the idea of a holiday economy and will allow Filipinos to profit from a long weekend.
