Solons suggest establishing a second NLRC division in Davao.

Rep. Paolo Duterte of the Davao City 1st District emphasized adding a new division to the National Labor Relations Commission (NLRC) on Sunday to enhance the quasi-judicial body’s handling of labor issues.

House Bill (HB) No. 4958, introduced by Duterte and Rep. Eric Yap of Benguet’s sole congressional district, creates a new section within the National Labor Relations Commission (NLRC) “in support of its mission to resolve labor disputes in the fairest, quickest, least expensive, and most effective way possible.”

The NLRC divisions would go from eight to nine under the proposed legislation.

According to the Philippine Labor Code, the first through sixth divisions of the NLRC are located in Metro Manila, the seventh in Cebu, and the eighth in Cagayan de Oro.

In accordance with HB 4958, Davao will be home to an additional ninth division that will deal with cases in Mindanao.

When the proposed measure becomes law, it would add three more NLRC commissioners, bringing the total number of members of the Commission—including the chairperson—to 27.

In the NLRC’s 2021 Performance Report, pending cases drastically decreased while the disposal rate was kept high.

The Commission reported 32,433 cases for mandatory arbitration, of which 24,262 were original cases from the Regional Arbitration Branches (RABs), and 8,171 were cases that were appealed to the Commission Proper.

The RABs and the Commission Proper disposed of 27,754 out of the 98 percent overall target set by the NLRC for an accomplishment percentage of 86 percent.

The RABs, however, could only reach 38% of their 2021 target for the percentage of cases resolved within three months of the filing or receipt of complaints.

A quasi-judicial organization affiliated with the Department of Labor and Employment is the NLRC. It is required to use alternative dispute resolution methods in addition to mandatory arbitration to resolve labor and management problems.

The presiding commissioner from the government and two additional commissioners who represent the employer and worker sectors make up each of the NLRC’s eight current divisions, each with three members.
