The Department of Tourism and the National Bureau of Investigation will produce a list of rogue quarantine hotels.

The Department of Tourism (DOT) on Thursday requested a list of hotels that have reportedly refused to participate in their investigation into quarantine skippers from the National Bureau of Investigation (NBI).

Those found to have violated or failed to comply with the mandatory protocols of the DOT, the Department of Health (DOH), or the Inter-Agency Task Force for the Management of Emerging Infectious Disease (IATF) may face “criminal penalties” such as fines and/or imprisonment, according to the DOT in a statement.

In addition, depending on the severity of the crime, these hotels may face “administrative penalties” such as suspension or revocation of their DOT certification.

“The Department of Transportation strongly advises all travelers and establishments to strictly adhere to the health experts’ and authorities’ established guidelines,” it stated.

This follows the discovery that a certain Gwyneth Chua, who had recently returned from the United States, had checked into the Berjaya Makati Hotel on December 22, 2021, and had left the next day for a party at a restaurant in Barangay Poblacion, Makati City.

Chua, numerous partygoers, and restaurant workers were later determined to be Covid-19 positive.

The hotel was closed by the Makati City government on Thursday as a result of the event.

The municipal government stated in an advisory that the hotel had breached DOT, the Department of Health, and the Inter-Agency Task Force for Emerging Infectious Diseases health and safety protocols [Section 36(h) of DOT Administrative Order No. 2021-004-A].

The establishment also disobeyed Republic Act 11332, generally known as the Mandatory Reporting of Notifiable Diseases and Public Health Concerns Act.

The hotel’s closure order came just one day after the Department of Transportation revoked its certification and forced it to pay fines.

The hotel complains.

The Berjaya Makati Hotel’s management declared in a statement that the local government’s action is illegal.

“For starters, the DOT order is not yet official because the hotel has fifteen days to file an appeal. The suspension is not in force at the moment. Second, there is no law that makes a hotel liable for failing to report a guest who avoids quarantine. Nothing in RA (11322) has anything to do with the hotel. Third, we must be given due process and be given the opportunity to explain ourselves before any penalty is enforced. The Makati City Hall has yet to give us our day in court “It was stated.

The closure order will also affect guests who are presently undergoing quarantine, according to the statement.

“We have 18 visitors who have tested positive but have not yet been removed by the Bureau of Quarantine, and 80 who are still in quarantine. We also have approximately 20 quarantine visitors arriving each week who have paid in advance. The public’s annoyance is unquantifiable, needless, and avoidable “According to the hotel.
