President Rodrigo R. Duterte has signed an act awarding survivorship benefits to a deceased retired member of the National Prosecution Service’s surviving legitimate spouse and dependent children (NPS).

The surviving legitimate spouse and dependent children of a deceased state prosecutor are entitled to all retirement benefits that the deceased was receiving or entitled to receive, provided that the deceased state prosecutor was eligible to retire optionally at the time of death, according to Republic Act (RA11643).

All prosecutors in the Office of the Secretary of Justice, the Regional Prosecution Offices, and the offices of the Provincial and City Prosecutors will be members of the NPS.

The term “dependent” is defined in RA 11643 as a legitimate, illegitimate, or legally adopted kid who is mostly reliant on the dead member of the NPS.

They must be under the age of 21, unmarried, unemployed, or incapable of self-support due to any mental or physical impairment or condition, regardless of age.

According to the legislation, the surviving legitimate spouse is entitled to collect retirement benefits for the rest of their lives until such spouse remarries, provided that the surviving spouse and dependent children split the retirement benefits equally.

The funding required to execute this Act immediately will be provided in the annual General Appropriations Act.

The surviving spouse and dependent children of a member of the NPS who died one year previous to the effective date of this Act are also entitled to the benefits set out in this Act.

Duterte signed RA 11643 on Tuesday, but it wasn’t made public until Thursday.

This legislation combines House Bill No. 9087 and Senate Bill No. 2373, which were passed by the Philippines’ House of Representatives and Senate on November 29, 2021, and November 8, respectively.
