Comelec defends 2nd Division executives against a ‘biased’ charge

The Commission on Elections (Comelec) defended its commissioners on Tuesday, dismissing claims that they were prejudiced.

Comelec spokesperson James Jimenez made the comment in response to the petitioner’s motion for partial consideration, which was filed in reaction to the Second Division’s dismissal of their petition to annul presidential aspirant Ferdinand “Bongbong” Marcos Jr.’s certificate of candidacy (COC).

“The Commission stands behind its commissioners’ honesty. But, because the ponente was Commissioner Socorro Inting, I expressly noted her extensive judicial expertise, including her time as a Court of Appeals justice. In a virtual press conference, he added, “Let the record speak for itself.”

It’s not unusual, according to Jimenez, for parties to a case under investigation to ask division authorities to put a hold on it.

“It is usual for parties to request that a certain commissioner or division be inhibited…as far as treatment of this is concerned, the Commission en banc will evaluate it.” “Whether or not someone will inhibit it depends on the person seeking suppression,” he stated.

Lawyer Theodore Te, representing petitioners Fr. Christian Buenafe and others, requested that the Second Division Commissioners — Inting, Antonio Kho, and Rey Bulay — disqualify themselves from the case’s review.

“They would have to decide whether or not they are capable of sitting in judgments on the topic with due impartiality, and that is their decision.” We’ve had commissioners voluntarily inhibit in the past, especially when the topic at hand is something to which they are personally connected or have a stake. “However, I can’t predict whether or not such an inhibition will occur in this case,” he continued.

The petition against Marcos was dismissed by the Second Division last week due to a lack of merit.
