Despite TROs, the Comelec plans to print ballots.

Despite the Supreme Court’s temporary restraining orders (TRO) in favor of the proclaimed nuisance candidates, the Commission on Elections (Comelec) will proceed with the printing of ballots for the May 9 elections.

The names of senatorial candidate Normal Cordero Marquez, vice presidential candidate Wilson Caritero Amad, and party-list group Juan Pinoy were not included in the official ballot on Tuesday, according to Comelec spokesperson James Jimenez.

“By the time the TROs were issued, the ballot serialization had already been done, thus the ballots were ready to be distributed.” So there was nothing left to do but print the ballots,” he remarked during a virtual press conference.

Despite the TROs, Jimenez stated it was the Comelec en banc’s choice to continue publishing.

“Recall the TRO; the ballots had been serialized, so the only thing left to do at that moment was to start printing,” he continued.

He said it wasn’t the first time the poll body had received a TRO from the Supreme Court, but it nevertheless went ahead and printed the ballots.

“This isn’t the first time, as far as I’m aware.” “It’s happened before,” he explained.

However, Jimenez stated that the polling organization is prepared in the event that the high court orders the printing of ballots to be halted after Marquez requested another intervention from the SC.

“Well, if the Supreme Court rules in favor of the Comelec, the Comelec is ready to follow the Supreme Court’s lawful decision.” But, for the time being, if he feels clearly wronged, he has the right to seek redress. He said, “We’ll see what happens with that petition.” “I have yet to get a notice that the Supreme Court has ordered the printing to be halted again; given what is at risk and the timelines we are working under, the Supreme Court has yet to issue such an order.”

“Remedies are available, and we would encourage them to take advantage of them,” Jimenez said of the aggrieved parties.

There are no restrictions on campaign contributions that have not been spent.

Meanwhile, Jimenez stated that there are no requirements for what a candidate must do with unspent campaign contributions.

“There are no regulations dictating how it should be handled,” he stated.

He was responding to Manila Mayor Francisco “Isko Moreno” Domagoso’s admission that he pocketed over PHP50 million in campaign cash from his lost senatorial attempt in 2016.

“The only rule that can be discovered is the revenue regulations issued by the Bureau of Internal Revenue, which specify very clearly that unspent campaign money is classified as income and are liable to payment of the proper income tax,” he stated.

According to Jimenez, the candidate and the donor would decide how to use the remaining campaign funds.

“If the donor finds nothing wrong with that use of the money they contributed, then that’s all there is to it.” He added, “subject to the payment of applicable taxes.”
