The NTC has given two companies permission to use channels that were previously used by ABS-CBN.

The National Telecommunications Commission (NTC) has granted two independent firms provisional authority (PA) to operate on digital television (TV) in Mega Manila using channels 23 and 43, which were previously utilized by broadcasting powerhouse ABS-CBN Corp.

The NTC stated in a statement on Wednesday that in an order promulgated on Jan. 5, 2022, it gave Aliw Broadcasting Corporation (Aliw) temporary authorization to “build, operate, and maintain” a digital TV broadcasting system utilizing channel 23.

“Aliw was the second applicant to construct, operate, and maintain a digital television in Metro Manila, filing under Cast No. 2007-0126 on July 30, 2007.” After going through a quasi-judicial process that included notice to all interested/affected parties and a hearing, ALIW has been waiting for an available digital TV frequency since 2007.”

The NTC, on the other hand, awarded the Swara Sug Media Corporation (SSMC), the legal operating name of Pastor Apollo Quiboloy’s Sonshine Media Network International (SMNI), provisional authority to install, operate, and maintain digital TV channel 43.

Both firms were given provisional authority after their “legal, technical, and financial qualification” was determined, according to the statement.

“Prior to granting the PA, the NTC sought policy guidance from the DICT, a legal opinion from the DOJ (Department of Justice), and concurrence from the OP-OES (Office of the President – Office of the Executive Secretary),” according to the NTC.

Cabinet Secretary Karlo Nograles emphasized in an interview with CNN Philippines that the NTC sought the legal advice and approval of the DOJ and OP-OES on the topic because it was a “purely legal question” and no identities of persons or companies were mentioned.

“The NTC’s visit to the OP-OES was only for the purpose of obtaining guidance on the authority to assign available and underutilized frequencies. “Once again, there was no reference of any name or business,” Nograles explained.

He added it was “up to the NTC based on their rules, regulations, and current laws” whether to give PAs to allow the operation of channels previously utilized by ABS-CBN.

The NTC awarded Villar-led Advanced Media Broadcasting System, Inc. a PA on Tuesday to install, operate, and maintain digital TV channel 16 as well as a temporary simulcast on analog TV channel 2.

The temporary assignment to utilize Channel 2 was given “for simulcast reasons only” until 2023 when analog television will be phased out as part of the country’s full transition to digital television.
