Toy labeling infractions are the subject of a group’s request to the FDA.

Laban Konsyumer Inc. (LKI), a consumer rights advocacy group, has called on the Food and Drug Administration (FDA) to take immediate action to ensure toy manufacturers’ strict compliance with Republic Act 10620, also known as the Toy and Game Safety Labeling Act of 2013.

The recent findings of public interest network EcoWaste Coalition on non-compliance with RA 10620, according to LKI president and former trade undersecretary Vic Dimagiba, need FDA action on the topic to assist protect children countrywide from dangerous toys.

EcoWaste should formally disclose such findings to FDA Director-General Dr. Rolando Enrique Domingo as soon as feasible, according to Dimagiba, so that this network can emphasize the importance of RA 10620 compliance.

“LKI is willing to join the demand that the FDA implement such a law,” he stated during a virtual press conference on toy safety held by EcoWaste on Tuesday.

“All toys and games imported, donated, distributed, and sold in the Philippines shall comply with the applicable regulations on safety labeling and manufacturer’s markings included in the Philippine National Standards for the safety of toys,” according to RA 10620.

“The display of written, printed, or graphic matter on any consumer product, its immediate container, tag, literature, or other suitable material affixed thereto for the purpose of giving information as to identify components, ingredients, attributes, directions for use, specifications, and such other information as may be required by law or regulations,” according to RA 10620.

According to EcoWaste campaigner Thony Dizon, the network purchased a variety of children’s toys from Metro Manila, Central Luzon, and Calabarzon (Cavite, Laguna, Batangas, Rizal, and Quezon) to assess their compliance with RA 10620 and other toy safety requirements.

“Only around 4% of those toys are appropriately labeled,” he stated.

Some of the toys, according to Dizon, are contaminated with lead, a toxin that is hazardous to children’s health and development.

EcoWaste, he said, will take Dimagiba’s advice and notify the FDA about such discoveries.

“As soon as practicable, we’ll provide (the) FDA with a copy of those findings,” he added.

LKI, according to Dimagiba, will also help consumers learn more about RA 10620 so they may make better decisions about what toys to offer their children.

“I’ll give this corresponding space and remind parents,” he said, “especially now that the government is encouraging people to go out and purchase.”

The FDA’s mission is to “ensure the safety, efficacy, or quality of health products, such as food, drugs, cosmetics, devices, biologicals, vaccines, in-vitro diagnostic reagents, radiation-emitting devices or equipment, and household/urban hazardous substances, such as pesticides and toys, or consumer products that may have an effect on health and require FDA regulations.”

Dimagiba also believes that the FDA’s performance so far in carrying out its mandate should be scrutinized.

He claims that the FDA’s repeated cautions are meaningless to consumers if the agency fails to enforce applicable laws and regulations.

EcoWaste provided numerous techniques for consumers to assist them choose safe toys for their children during the press conference, including inspecting information on toy labels to assess product components and manufacturing facts.

Consumers, according to Dizon, must select toys that are appropriate for children’s ages and abilities.

He advised them to stay away from toys with qualities that could cause bodily harm to children.

Consumers should also buy toys from reliable businesses and ask for receipts to show that they bought them from them, he added.
