Under Republic Act (RA) No. 11313, or the Safe Spaces Act, the Department of Justice (DOJ) authorized a draft of guidelines for cases of Gender-Based Online Sexual Harassment (GBOSH) on Friday.

The draft will govern evidence collecting and case building for the GBOSH violations, according to DOJ Office of Cybercrime (DOJ-OOC) Officer-in-Charge Charito Zamora in a statement.

The draft designates the Philippine National Police-Anti-Cybercrime Group, as well as the National Bureau of Investigation-Cybercrime Division, to receive complaints of GBOSH cases.

When an investigation necessitates collaboration with overseas counterparts, law enforcement agencies must consult with the DOJ – OOC.

GBOSH is defined by RA No. 11313 as a criminal act that uses information and communications technology to terrorize and intimidate victims through

1. physical, psychological, and emotional threats, unwanted sexual misogynistic, transphobic, homophobic, and sexist remarks and comments online, whether publicly or through direct and private messages;

2. cyberstalking and incessant messaging;

3. uploading and sharing without the victim’s consent any photos, voice, or video; and

4. cyberstalking and all forms of sexual harassment in streets and public spaces, including workplaces and educational and training institutions, are prohibited under the Safe Spaces Act.
