MANILA, Philippines – The Supreme Court (SC) has dismissed a petition filed by a Bulacan mayor challenging the validity of a 2017 recall petition against him.

The Supreme Court en banc “dismissed for being moot and academic” the suit filed by former Pandi, Bulacan mayor Celestino T. Marquez following the expiration of his term in 2019.

“In light of the fact that the petition for recall sought to remove petitioner for the remainder of his term, which expired in 2019, we note that the petition is moot,” the court ruled.

Marquez petitioned the Supreme Court to review the Commission on Elections’ (Comelec) 2018 decision to allow Arnold P. Lagdameo’s recall petition to proceed despite what Marquez claimed were defects in the petition.

Marquez contended that the signature sheets omitted to indicate the official sought to be recalled, omitted to include a brief narration of the petition’s reasons and justifications, and omitted to include original documents.

The Comelec determined that substantial compliance had occurred since Marquez was designated as “Mayor,” and that no other official was sought to be recalled in the petition.

Additionally, the polling organization stated that the required percentage of petitioners who supported the measure was met.

“We would like to remind the Comelec that it must strictly adhere to all requirements imposed by applicable laws regarding the conduct of elections and the exercise of the electorate’s recall power, if only to uphold the people’s sovereign will and safeguard the rule of the majority,” the SC stated.
