Netizens increase the number of counterfeiting reports and complaints to a new high.

MANILA, Philippines – In 2021, the Intellectual Property Office of the Philippines (IPOPHL) received 151 counterfeiting and piracy reports from consumers and complaints from rights holders, exceeding the previous high of 121 in 2020 and showing a 25% year-on-year rise.

According to data from the IP Rights Enforcement Office, netizens contributed the most to the new record, accounting for 113 or 75 percent of reporting and complaint filings, followed by IPOPHL’s own monitoring and referrals from other government agencies (29 or 19 percent), and intellectual property (IP) rights holders (nine or 6%). (IEO).

Counterfeiting received 114 reports and complaints, accounting for 75% of all reports and complaints. Apparel goods continued to be the most counterfeited, accounting for 85 percent of the total.

Perfume and beauty products came in second with eight counts (7%), followed by pharmaceutical and medical products with five counts (4%) and other items like umbrellas and keychains with five counts (4 percent).

The IEO received 37 reports and complaints about piracy. With 18 counts, general and educational books and e-books accounted for 49% of the total. With nine records each and a 24 percent share of the total piracy tally, software and TV shows/movies were the next most sold or shared unlawfully online.

Piracy and counterfeiting were still rampant in the internet world, with 136 of the 2021 reports and complaints citing infractions on e-commerce platforms, social media, and other websites.

According to 87 online documents, Facebook was still at the center of alleged IP infringement. Shopee came in second with 27 reports or complaints, followed by Lazada with ten, Instagram with four, and Carousell with two.

“We’re encouraged to see the online community continue to lead the way in fostering a more aware IP environment in the face of increased content demand and revived consumer interest.” Since the commencement of the Covid-19 (coronavirus disease 2019) pandemic, we’ve seen an increase in counterfeiting and piracy reports, which we’ve responded to with increased IP awareness and enforcement actions. “The active cooperation of netizens in addressing IP infringement is a tangible result of our efforts,” said Ann Edillon, IEO officer-in-charge.

“We advise IP rights holders to use online platforms’ IP protection capabilities to find more strategic approaches to combat IP infringement,” Edillion said.

If online IP protection features are unable to alleviate the IP rights holder’s concerns, a formal complaint can be made with IPOPHL for further investigation and the issuing of an enforcement order from the IEO or a restraining order from the Bureau of Legal Affairs.

The IEO accepts reports by e-mail (operations@ipophil.gov.ph), phone (+639950220522), and Facebook page, according to Edillon.
