Smartmatic’s suspected data breach was the subject of a Comelec report released on Wednesday.

MANILA, Philippines β€” Following claims of a security breach, the Commission on Elections (Comelec) expects to receive a report from its law department on Wednesday regarding the probable civil and criminal culpability of its service provider Smartmatic International.

“We instructed our legal department to produce their findings on what, if any, criminal and civil liabilities our service provider may face by tomorrow (Wednesday).” Commissioner George Garcia gave a press conference following the signing of a peace covenant between the poll authority, the police, and the military for clean and peaceful votes in Catbalogan, Samar on Tuesday.

He also stated that they are awaiting the National Bureau of Investigation’s (NBI) findings on the case.

“When we asked if we could go a little faster, they promised to call two or three people and then submit the report to us.” We don’t have control over the NBI, so the Commission en banc authorized our executive director to work with the NBI and the Department of Information and Communications Technology (DICT) to figure out what happened. Because, as far as the Comelec is concerned, we’d like to know if any data or systems have been compromised,” he added.

Garcia further stated that their information and technology staff was instructed to present a credible strategy in the event that such an occurrence occurred again.

Senator Imee Marcos, chairperson of the Joint Congressional Oversight Committee (JCOC) on the Automated Election System (AES), revealed in a previous hearing that the service provider had a security breach after one of its contractual workers allegedly took out an official laptop and leaked its contents.

Meanwhile, Garcia stated that they are looking into expanding their efforts to forge peace agreements among aspirants and stakeholders ahead of the upcoming election.

They want to form a covenant with local aspirants in Zamboanga City, Basilan, Sulu, Tawi-Tawi, General Santos City, Maguindanao, and Cotabato City, in addition to Marawi City and Samar.

“We’ll also travel as far north as Abra,” Garcia added.

Comelec officials, led by chairman Saidamin Pangarungan, traveled to Marawi City on March 26 to sign the peace treaty.
