Due to a forged license, the Supreme Court (SC) has declared the marriage null and void.

MANILA – The Supreme Court (SC) has affirmed the Court of Appeals (CA) in declaring marriage between two people void ad initio (from the beginning) due to the lack of a marriage license when they were married.

The SC Second Division denied a petition filed by state lawyers challenging the CA’s 2018 ruling, which affirmed the 2013 verdict of the Caloocan regional trial court (RTC Branch 130) on Reynold Q. Lazaro’s nullity of marriage lawsuit against his wife of five years, Jackelin L. Navarro-Lazaro.

After the woman became pregnant, the two married under civil rituals at the Las Pias City Hall, but eventually divorced. During the procedures, it was determined that the marriage license reportedly granted by the municipal civil registrar of Imus, Cavite, was fraudulent because it was neither issued by the Imus civil registrar nor among the licenses listed at the same office.

The CA upheld the RTC’s finding that “the certification from the local civil registrar was adequate to prove the non-issuance of a marriage license.” Government lawyers tasked with preventing collusion between spouses in obtaining a quick divorce appealed the RTC ruling to the CA, which upheld the RTC’s finding that “the certification from the local civil registrar was adequate to prove the non-issuance of a marriage license.”

The marriage license supplied was also a photocopy, according to the CA.

The SC affirmed the CA and the RTC, saying that “certification(s) provided by the civil registrar held probative value, as his role was to preserve records of data related to the granting of a marriage license,” and that “the subject marriage was void due to the absence of a marriage license.”

The court also stated that no testimony had been given as to how the pair obtained the alleged marriage license in the first place.
