Government employees’ night shift differential compensation has been approved.

MANILA – According to a new law issued by President Rodrigo Duterte, government employees will now get a night shift differential pay.

Government employees, including those in government-owned or controlled organizations (GOCCs), are entitled to a night shift differential pay under Republic Act (RA) No. 11701, which was signed by Duterte on April 13.

“Government employees in position items from Division Chief and below, or their equivalents, including those in government-owned or -controlled corporations, shall be paid a night shift differential at a rate not exceeding 20% of the employee’s hourly basic rate, as determined by the head of the agency, for each hour of work performed between the hours of 6 in the even and 6 in the odd, whether the nature of their employment is permanent, contractual, temporary, or casual.”

The night shift differential compensation given by RA 11701 will be in addition to, and not in any way reduce, whatever benefits and allowances government employees currently receive.

The hourly basic rate is the hourly salary rate calculated by dividing the basic monthly rate by 22 working days and then dividing the quotient by eight hours.

Employees whose planned office hours fall between 6 a.m. and 6 p.m. are not protected by the Act.

Overtime compensation is compensated for services provided outside the standard eight-hour work schedules in compliance with existing laws, rules, and regulations.

Employees of the Armed Forces of the Philippines, the Philippine National Police, the Bureau of Jail Management and Penology, the Bureau of Fire Protection, and others similarly situated as determined by the Civil Service Commission (CSC) and the Department of Budget and Management are also not covered (DBM).

The CSC, in collaboration with the DBM, must provide the necessary rules and regulations to ensure that this activity is carried out effectively.

The amount must be charged against existing appropriations for the departments, bureaus, offices, and agencies concerned in national government institutions.

Following that, any additional funds required to carry out this act must be included in the annual general appropriations act.

The payment shall be charged against the funds of local government entities, according to Sections 325 and 331 of Republic Act No. 7160, or the Local Government Code of 1991.

The amount will be assessed against the GOCCs’ and subsidiaries’ respective corporate funds.
