Duterte signs the Timbangan ng Bayan legislation.

MANILA – President Rodrigo Duterte has approved a bill that would establish Timbangan ng Bayan centers in public and commercial marketplaces to safeguard consumers from fraudulent and unfair sales practices.

Duterte signed RA 11706 on April 13 to amend Chapter II, Title III of RA 7394, also known as the Philippine Consumer Act.

Article 62-A of the new law mandates that all provincial, city and municipal governments create accessible Timbangan ng Bayan Centers in all public and commercial markets, including supermarkets, as well as flea markets, tiangges, and grocery stores, within their respective jurisdictions.

Consumers will be able to use Timbangan ng Bayan Centers to verify the correctness of the weight and quantity of the goods they are purchasing.

“These centers must have the appropriate tools for calculating weights and measures,” according to the law, “which shall be available, free of charge, to any persons who need to validate the accuracy of the number of measurements of products purchased or about to be purchased.”

According to the law, the market supervisor is responsible for the safekeeping and routine maintenance of the Timbangan ng Bayan instruments, as well as keeping a record of every product found to be deficient in quantity or dimension, as well as the establishment where it was purchased, including the name(s) of the proprietor(s) or manager(s).

A certificate lawfully issued by the market supervisor or his or her authorized representative reflecting the contents of such record will be prima facie proof of a breach of this act’s Article 64.

Fraudulently modifying, tampering, vandalizing, or destroying any scale, balance, Timbangan ng Bayan instrument, weight, or measure after it has been duly sealed is forbidden under RA 11706.

In terms of punishment, anyone who does banned activities faces a fine of not less than PHP50,000 but not more than PHP300,000, or a sentence of not less than one year but not more than five years in jail, or both, according to on the court’s discretion.

On conviction, the owner, possession, or user of weights and measures devices will face a fine of not less than PHP50,000 but not more than PHP300,000, or imprisonment for not less than one year but not more than five years, or both, according to the court’s discretion.

The erring individual’s or business establishment’s business permit will be promptly revoked after two consecutive offenses.

The Departments of the Interior and Local Government and Trade and Industry must promulgate rules and regulations to effectively implement the provisions of this act in collaboration with the Union of Local Authorities of the Philippines, the League of Provinces of the Philippines, the League of Cities of the Philippines, the League of Municipalities of the Philippines, and other relevant government agencies and stakeholders.

The amount required to carry out the terms of the new Article 62-A of the Philippine Consumer Act will be deducted from the local government unit’s national tax allotment and other monies.
