MANILA – President Rodrigo R. Duterte has signed a bill that extends the validity of firearms and ammunition licenses.

RA 11766, signed by Duterte on May 6, amends RA 10591, the Comprehensive Firearms and Ammunition Regulation Act, by extending the validity of the license to possess firearms and ammunition from two to five or ten years.

RA 11766 stated, “All permits to possess a firearm, regardless of type or classification, shall be renewed every five or 10 years, at the option of the licensee, which shall be reckoned from the said licensee’s birthdate, unless sooner canceled or suspended.”

“Failure to renew the license on or before the date of its expiration shall result in the revocation of the license and registration of the firearm or firearms under such licensee,” it continued.

Similarly, the firearm’s registration must be renewed every five or ten years, depending on the licensee’s preference, and is calculated from the licensee’s birthdate unless revoked or suspended sooner.

Failure to renew the firearm’s registration on or before the expiration date will result in the revocation of the firearm’s license. After due process, the firearm will be confiscated or forfeited in favor of the government.

The law specified that “failure to renew a license or registration within the periods stated above on two times shall result in the holder of the firearms being permanently disqualified from applying for any firearm license.”

The application for renewal of the license or registration must be submitted to the Philippine National Police’s Firearms and Explosives Office (FEO) within six months of the license or registration’s expiration date.

RA 11766 further stipulates that permission to carry a firearm outside of the home is valid for two years from the date of application approval, unless it is canceled or suspended sooner.

The new legislation exempts elected incumbent and past officials, as well as active and retired military and law enforcement professionals, from the threat assessment certificate requirement.

Members of the Philippine Bar, certified public accountants, accredited media practitioners, cashiers, bank tellers, priests, ministers, rabbis, imams, physicians and nurses, engineers, and businessmen who, by the nature of their business or undertaking, are at high risk of being targets of criminal elements are also exempted.

The Philippine National Police (PNP) chief is required by law to draft rules and regulations for the law’s successful execution.

The failure to provide implementing rules and regulations must not preclude the effective implementation of this legislation.

Senate Bill No. 1155 and House Bill No. 10610 were passed by the Senate and House of Representatives on February 2, 2022, respectively.
