DFA: China’s SCS fishing restriction harms trust.

Manila: The Philippines criticized China’s yearly fishing restriction in the South China Sea, which covers Philippine waters.

The prohibition encroaches on Philippine territory and exclusive economic zone (EEZ), including Bajo de Masinloc. The Department of Foreign Affairs (DFA) protested the embargo on May 30.

In a statement, the DFA claimed its imposition undermines mutual trust and respect between the two nations.

“The DFA protested China’s annual practice of proclaiming a fishing ban over areas much beyond its rightful maritime entitlements under 1982 UNCLOS,” it stated.

“The announcement of a fishing moratorium that extends to the West Philippine Sea has no legal foundation and undermines the mutual trust, confidence, and respect that should underpin bilateral relations,” the statement said.

The agency urged China to “comply with international law, including the 1982 UNCLOS and the South China Sea Arbitration Award.”

It stated China must “stop and desist from illegal measures that undermine” the Philippines’ sovereignty, sovereign rights, and jurisdiction in its maritime zones; and stick to its 2002 pledges in the South China Sea Declaration (DOC).

Paragraph 716 of the 2016 Arbitral Award states that China breached Article 56 of the 1982 UNCLOS by banning fishing in the South China Sea “without exception for areas of the South China Sea falling within the Philippines’ exclusive economic zone and without limiting the moratorium to Chinese flagged vessels”
