MANILA, Philippines β€” President Rodrigo Duterte has the option of either not renewing the ad interim appointments or reappointing the bypassed officials, including the chiefs of the Commission on Elections (Comelec), Civil Service Commission (CSC), and Commission on Audit, according to House of Representatives Deputy Speaker Rufus Rodriguez (COA).

Rodriguez made the statement in response to the Commission on Appointments’ decision to bypass Comelec Chairman Saidamen Pangarungan, Comelec Commissioner George Garcia, Comelec Commissioner Aimee Torrefranca-Neri, CSC Chairman Karlo Nograles, and COA Chairperson Rizalina Justol’s ad interim appointments.

During the congressional election hiatus, Duterte appointed them.

“I believe the President would go for the first alternative and allow his successor to fill the Comelec, COA, and CSC openings, similar to how the CA bypassed appointees to offer the incoming President the same opportunity,” he said.

Rodriguez stated that if they are reappointed, they may face the same fate as they did last Wednesday in the CA of the next Congress.

“By then, the new President would have taken office and will have complete discretion in selecting or nominating constitutional officers,” he explained.

Rodriguez stated that the chairmanships of the three constitutional commissions, as well as two other positions, will be relinquished on Saturday, rather than June 30, as the official dissolution of Congress according to the legislative calendar.

“These offices become vacant by operation of the Constitution and the CA rules when the Congress adjourns,” he explained.

According to Rodriguez, Section 16 of Article Vll (on the Executive Department) of the Constitution contains the President’s appointing power as well as the extent and authority of the CA to consent to or ratify such nominations.

According to him, Section 16’s second paragraph, which relates to the five skipped appointees, states:

“During the recess of the Congress, the President shall have the ability to make appointments, whether voluntary or mandatory, but such appointments shall be effective only until the Commission on Appointments disapproves them or until the next adjournment of the Congress.”

According to him, this provision makes it obvious that the nominations made to the five constitutional officers are only effective until June 3.

Communication Secretary Martin Andanar, acting Presidential Spokesperson, stated they accept the CA’s decision to circumvent the outgoing President’s choices.

“We recognize the power granted in the Commission on Selections by the Constitution, and we further respect its ability to ratify the President’s appointments,” Andanar said in a statement.
