Cavite 7th district special election to be scheduled by Comelec and House

The scheduling of a special election for the seventh legislative district of the province of Cavite is currently being coordinated by the Commission on Elections (Comelec) and the House of Representatives (HoR), according to a statement made on Thursday.

The Comelec’s Office of the Executive Director and the Deputy Executive Director for Operations, according to acting spokesperson John Rex Laudiangco, is responsible for coordinating with the legislature on this issue.

“The Commission’s consideration of the vacancy in question begins with the Certification granted by the lower house. The appropriate budgetary appropriations will often be included in the formal communication of this certification to the Comelec. In response, we shall work with the HoR to determine the schedule and date of special elections. According to acting Comelec spokesperson John Rex Laudiangco, this is the standard procedure.

The 1987 Constitution’s Article VI, Section 9 states that “a special election may be called to fill such vacancy in the Senate or in the House of Representatives in the manner provided by law, but the Senator or Member of the House of Representatives thus elected shall serve only for the unexpired term.”

The establishment of the schedule of events, notably the special election period and special Election Day, will necessitate/request appropriations on the budget, according to Laudiangco.

He continued by saying that various procurement processes for special ballots, accountable and non-accountable forms, other supplies (such as anti-coronavirus supplies), and the corresponding training for the Special Electoral Boards and Special Provincial Board of Canvassers will come after this.

On the other hand, he pointed out that this event will not have an impact on the upcoming Barangay and Sangguniang Kabataan Elections (BSKE) preparations.

“BSKE preparations are already in motion, so this won’t materially slow down our schedule. But if things go as planned, as indicated by the House Resolution and Certification of Vacancy to be officially communicated to Comelec, important preparations will unavoidably encompass the following and require careful consideration: budget, procurement training, the Comelec official stated.

The commission’s funding for this year, he continued, is only sufficient to carry out the elections scheduled for May 9 and the BSKE on December 5.

The grant of which will pave the way for the various procurement activities and training. “We will be checking for appropriate sources of funds, and if there is none or the same will be insufficient, we will be requesting for the appropriate funding/supplement for the conduct of this special elections,” he added.

When President Ferdinand Marcos Jr. appointed then-Rep. Jesus Crispin Remulla, who had won the May 9 elections, to the position of Justice Secretary, the seventh congressional district seat in Cavite fell vacant.

The position was officially declared vacant by the chamber by Resolution No. 100 of July 27, and a request was made to the Comelec to hold a special election to fill the vacancy.
