PRC does away with the “utang tagging” rule for license renewal.

A regulation outlined in Memorandum Order No. 44 by the Professional Regulation Commission (PRC) that bars professionals with open administrative proceedings from renewing their PRC licenses have been stopped.

In a statement released Sunday, Labor Secretary Bienvenido E. Laguesma stated that the suspension is effective immediately.

The PRC is a DOLE-affiliated organization.

Resolution No. 1558 was a response to the “utang-tagging” concern brought up by ACT Teachers Party-List Rep. France Castro during last week’s legislative discussion of the DOLE budget. It was signed by PRC acting chairman Jose Cueto Jr. and commissioner Erwin Enad.

According to this rule, teachers are prohibited by the PRC from renewing their licenses due to allegedly outstanding debts.

Laguesma was troubled by the “utang-tagging” policy since it overburdens professionals with active administrative issues. The labor minister questioned, “How can they pay what they borrow if they can’t work because the PRC won’t renew their licenses?

While “utang tagging” is put on hold, according to Cueto, the PRC will evaluate its processes and disciplinary procedures and engage with its numerous professional boards in an effort to improve efficiency and justice.

Laguesma praised the PRC for acting swiftly to address the problem, stressing that this would bring immediate relief to other professionals and teachers.

While stressing that paying debts and maintaining professional discipline remain of the utmost importance, he also made it clear that the PRC should concentrate its regulatory function on undesirable acts resulting from the practice of the professions when reviewing its policy and disciplinary procedures.

He continued by saying that every regulation should stand up to the reasonableness test and shouldn’t be used to penalize professionals based only on their socioeconomic status.
