PCC seeks a ‘position’ in the body that approves frequency reallocation.
The Philippine Competition Commission (PCC) has requested that the National Telecommunications Commission (NTC) alter its rules to allow it to join the approving committee for frequency reassignment.
Following the reallocation of frequencies previously used by ABS-CBN to Advanced Media Broadcasting System (AMBS), Aliw Broadcasting Corporation (ABC), and Swara Sug Media Corporation, PCC issued the announcement (SSMC).
“The PCC suggests modifying the rules to make it the approving body for the assignment of vacant or available frequencies.” Many governments across the world do this to account for the impact on player competition over scarce public assets like frequencies,” according to the antitrust authority.
The NTC, the Department of Information and Communications Technology, the Department of Justice, and the Malacanang Palace are among the approving bodies for frequency reallocation cited in the NTC rule, which existed even before the Philippine Competition Act (PCA) was established in 2015.
The PCC explained that the transfer of frequencies is not subject to the PCA’s merger review rules and hence does not require notification to the PCC.
“In the case of AMBS, this restricts PCC’s authority until the Villar Group’s acquisition of AMBS, including its relationship with Streamtech Systems Technologies Inc., is made public,” it continued.
The PCC also stated its support for the approval of the Open Access in Data Transmission Act, which will allow for more transparent and equitable spectrum management, which is a valuable public resource.
“The PCC’s overall principle is to create a level playing field for new and existing players.” “During the tenancy of AMBS, ABC, and SSMC as interim authority-holders of frequencies previously administered by ABS-CBN, the PCC invites the public’s attention to check on the quality and price options available to the viewing public,” it stated.
