The Court of Appeals (CA) upheld a verdict to close an Antipolo City school.

In a May 26 resolution, the CA denied St. James Colleges of Antipolo City Inc.’s application for review of the 2021 decision upholding the school’s operating permit revocation.

St. James failed to meet regulatory requirements that a private school own its location, thus the school appealed the DepEd ruling.

DepEd regulations give a school without a site five years to buy one.

St. James Community Colleges of Antipolo City, founded in 1989, closed on May 25, 2014.

The first incorporators built St. James Colleges of Antipolo City and requested for a permit.

Jason Gene Baltao contested the DepEd permit, saying the school’s site was a “open place regarded for public use and outside the commerce of men”

The school stated it had a donation document.

The CA ruled that the petitioner did not obtain title through the deed of donation because the donor stated in the deed that it was not the property’s owner.

The court cannot reverse the DepEd’s order to close the school since it failed to purchase a location within five years of applying for a permit.
