Tolentino wants to create regulations to safeguard caregivers.
On Thursday, Senator Francis Tolentino stressed the necessity of institutionalizing legislation to safeguard the welfare of Filipino carers and their right to respectable employment.
Tolentino emphasized that these laws must be passed in order to preserve high and globally competitive standards for caregiver professional service, taking into account the crucial role that caregivers play in national development.
After introducing Senate Bill 1396, also known as the “Caregivers Welfare Act of 2022,” he declared that caregivers “must also be protected from abuse, harassment, violence, and economic exploitation.”
According to the proposed legislation, a caregiver will be guaranteed a salary that is at least the minimum wage, set working hours, overtime compensation, and memberships in the Social Security System (SSS), Philippine Health Insurance Corp. (PhilHealth), and Home Development Mutual Fund (Pag-IBIG).
It suggests that the Labor Code and the employment contract that the parties have signed govern a caregiver’s hours of work.
The policy would also make sure that domestic caregivers receive the most basic necessities, such as three nutritious meals a day and a comfortable place to sleep.
The employer shall also provide the caregiver with reasonable rest and help in the event of illnesses or injuries received while performing the caregiver’s tasks and responsibilities, without regard to loss of benefits.
Many nations, including the US, Canada, the Middle East, Europe, and Asia (including Japan and Korea), choose Filipino caregivers because of their unwavering and sincere love for their patients, according to Tolentino’s bill.
However, research by the Economic Policy Institute in July 2021 revealed that carers are frequently paid less than the legal minimum wage and “are grossly underappreciated and underpaid” in many nations throughout the world.
