Guidelines for the payment of regular employees’ 13th-month pay in the private sector were released by the Department of Labor and Employment (DOLE) on Monday.

Labor Secretary Bienvenido Laguesma reminded the companies and offered the calculation of the required benefit for employees in Labor Advisory No. 23.

According to the regulations, the minimum 13th-month pay cannot be less than one-twelfth (1/12) of the employee’s annual basic salary total.

“To illustrate Proportionate 13th-month pay = total basic salary earned throughout the course of the year, divided by 12 months. Using a six-day workweek and the PHP570 daily minimum wage for the National Capital Region, this equates to an equivalent PHP14,867.50 monthly basic salary (PHP570.00*313/12 months). The equivalent 13th-month compensation is PHP14,345 (PHP172,140 divided by 12 months), according to the DOLE.

Rank-and-file employees in the private sector who have worked for at least one month during the calendar year are eligible for the 13th month of pay, regardless of their job, designation, or employment status, and regardless of how their salaries are paid.

The benefit must be paid by December 24 or earlier, it was added.

The competent DOLE Regional/Field/Provincial Office with jurisdiction over the workplace “must enforce compliance with the 13-month pay in accordance with the applicable rules and regulations,” it continued.

The edict further said that there would be no exceptions or delays in awarding the required bonuses to employees.

In addition, it stated that “no request or application for exemption from payment of 13th-month pay, or for delay of payment thereof, shall be recognized and allowed.”
