DMW begins assuming control of DFA’s national aid program

Together with the Department of Foreign Affairs, the Department of Migrant Workers has begun the process of transferring the Assistance to Nationals (ATN) function from the latter to the newly established department as part of its mandate to protect and promote the welfare of overseas Filipino workers (OFWs).

The handover also involves moving legal aid money from DFA to DMW, ensuring that all OFWs around the world continue to get service.

According to Common Circular No. 1, series of 2023, which was signed on Wednesday by DMW Secretary Susan Ople and DFA Secretary Enrique Manalo, a technical working group will be established to develop joint policies and procedures that would lead to the transition’s completion.

The delegation of the aforementioned responsibilities complies with the requirements set forth in Republic Act 11641, which was signed by the late President Rodrigo Duterte in December 2021 and established and mandated the DMW to oversee all laws and regulations pertaining to the welfare of Filipinos employed abroad.

The DMW Undersecretary for Foreign Employment and Welfare Services and the DFA Undersecretary of Migrant Workers Affairs will jointly chair the TWG.

Three authorized representatives from the DMW and the DFA will join them.

In addition to developing rules, the TWG is tasked with ensuring a seamless and effective transfer in the management of services and assistance to OFWs at all Foreign Service Posts (FSPs), which are currently under the DFA.

According to the joint circular, until March 31, 2023, when it is anticipated that the entire turnover would have been accomplished, the DFA shall continue to oversee the provision of the ATN and other services to OFWs in embassies and consulates abroad.

The DFA is required to “retain and disburse ATN and legal assistance money to assist OFWs until such time as the respective Migrant Workers Office (MWO) is fully equipped with the operational and financial needs to offering such assistance” throughout the aforementioned time frame.

ATN concerns pertaining to OFWs will be managed and handled during the transition time with the help of training and mentoring from the DFA provided to DMW-MWO staff.

Additionally, for better facilitation, the DFA will pass over to the DMW all ATN cases, replete with data and an inventory of such instances.
