Solon wants to seek an annulment in churches and other religious groups
A Senate bill calls for the submission of requests for marriage annulments to the Church or any other religious sect.
According to Senate Bill 2047, also known as the Church Decree Annulment Act, which grants them the legal authority to perform marriage ceremonies, it is only just that annulment cases be brought before them.
It is only logical for the same church or religious sect to have the power to rule on a marriage’s nullity, “which ideally must take the same effect in the eyes of the State,” according to author Senator Robinhood Padilla. This is because the Family Code of the Philippines permits marriage to be solemnized by a priest, rabbi, or minister of a church or religious sect and registered with the Civil Registrar General.
Representatives Jude Acidre and Yedda Marie Romualdez of the Tingog Party list submitted a similar bill, which was approved by the House Committee on Population and Family Relations on February 23.
In the event that the bill is passed into law, according to Acidre, a pronouncement of nullity (of marriage) made by the Church will carry the same weight and have the same consequences as a legal annulment.
The high cost of payment and case backlog, according to Padilla, will be resolved by his idea, which will also relieve people who are stuck in unhealthful and violent relationships.
The Family Code of the Philippines will be used to establish the status of children of marriages that are subject to a church annulment or dissolution judgment.
He emphasized that their common children born or conceived before the issuance of the church annulment decision shall be recognized as legitimate if the basis for church annulment or dissolution is not equivalent to any of the grounds in the Family Code.
The bill requires the spouses to reach an agreement about the division and distribution of the property, as well as the custody and upbringing of any shared children. The requirements of the Family Code must be followed if no agreement can be reached.
Within 30 days of its issuing, the church annulment decree must be registered in the proper civil records together with the spouses’ consent.
After then, either ex-spouse is eligible to get married again.
In the meanwhile, Padilla introduced Senate Bill 2048, also known as The Film and Live Events Recovery Act, which would have exempted Filipino-owned local productions from entertainment taxes and granted them tax breaks in order to make up for losses sustained during the pandemic.
All domestically created artistic works with Filipino copyrights and local productions with at least 10% Filipino equity are free from amusement tax under the proposed legislation.
It also reduces the amusement tax collection cap under the Local Government Code from the current 10% to 5% and offers the film and music sectors a two-year tax exemption.
“Thus, it is essential to provide our film and music businesses with the required push to grow and recover from the epidemic and new obstacles that caused them enormous losses,” stated the bill’s explanatory note. “This will benefit our people and economy.”
As a result of the current levies, he claimed that none of the locally made movies in 2022 would achieve PHP10 million in total sales, barely breaking even.
The measure exempts domestically produced films, musical plays, operas, concerts, dramas, recitals, exhibits of paintings and other works of art, flower shows, musical performances, and literary and oratorical performances from paying entertainment taxes.
