πΈ Airline Ordered to Pay P500K in ‘Damages’ for Overbooking π«
The regional trial court in Mandaue City has ruled that Cebu Pacific Air must pay PHP500,000 in damages to Provincial Board Member Glenn Soco of Cebu’s 6th District. The court found the airline guilty of “breach of the obligation to transport” Soco, resulting in inconvenience, serious anxiety, physical suffering, and sleepless nights.
Presiding Judge Ferdinand Rafanan of Mandaue City’s RTC Branch 55 ordered Cebu Pacific Air to pay Soco PHP200,000 in moral damages, PHP200,000 in exemplary damages, and PHP100,000 for attorney’s fees and litigation expenses.
The case dates back 12 years, with Soco filing a complaint against the airline for bumping him off his scheduled flight from Manila to Cebu.
According to court documents, Soco had booked a roundtrip ticket from Cebu to Manila. His Cebu-Manila flight was scheduled for April 15, 2011, with the return flight to Cebu on April 16, 2011, at 10:10 a.m. Soco’s ticket was confirmed, and he arrived at NAIA Terminal 3 to check-in. However, he was informed that he could no longer be accommodated on the flight. While he sought clarification, other passengers urged him to step aside, leading to a chaotic and humiliating scene.
The court decision noted that Soco missed his board meetings and experienced humiliation. At the time, Soco owned Mandaue Integrated Manpower Services Inc., Coffee Dream Company, and Powerline Human Resources Management Inc.
Ivan Henry Gaw, Cebu Pacific Air’s guest service manager, confirmed that Soco could not board because the airline’s system showed full capacity during check-in. The airline’s standard policy is to seek volunteers willing to give up their seats or offer passengers the option to take a subsequent flight or receive a refund.
The airline official cited Civil Aeronautics Board Economic Regulation No. 7, which allows airlines to overbook by up to 10 percent of the aircraft’s seating capacity.
