Senator calls for the jailing of a hit-and-run SUV driver.
MANILA, Philippines — According to Senator-elect JV Ejercito, prison time will provide the driver of the SUV who intentionally ran down a security guard, fled the scene, and surrendered 10 days later an opportunity to reform.
In a Facebook video posted on Friday, Ejercito expressed his hope that the prosecution of the Mandaluyong hit-and-run event on June 5 will bring Christian Floralde, who was hospitalized for four days after suffering significant bodily injuries.
“At hindi na tumakas, mabuti at sumuko na rin siya. Dapat noon pa (It’s a good thing he surrendered and didn’t flee.) He should’ve done it sooner), “Ejercito remarked.
Jose Antonio Sanvicente, the SUV driver, must “bear the repercussions of his action,” Ejercito said in a tweet on Friday.
Sanvicente has a history of stabbing an elderly person as a result of a traffic conflict, according to Ejercito’s research.
After seeing the viral video of Sanvicente hitting and running over Floralde, the re-elected senator announced a prize of PHP50,000 to anyone who can help find the driver.
Meanwhile, outgoing Senate President Vicente Sotto III expressed dismay following Sanvicente’s surrender to the Philippine National Police (PNP) on Wednesday and accompanying press conference.
“In a Viber message to Senate reporters, Sotto said, “Please inform the PNP and the hit-and-run driver’s lawyer that they must implement Republic Act 10586, the Anti-Drunk and Drugged Driving Law.”
He further claimed that the PNP did not follow protocol.
“What are the legal procedures? After that, brush up on the subject of illegal substances. If you employ a complete drug test, it can take weeks to wipe up any sign of genuine harmful drugs. Attention: PNP spokesman!” Sotto sent out a tweet.
Col. Jean Fajardo, a spokeswoman for the Philippine National Police, stated during a recent press conference that they had no legal grounds to detain Sanvicente.
“To alert the public, the PNP has no legal reasons to detain itong (this) suspect, given na wala pa namang (that there is still no) warrant of arrest na na-issue sa kanya (that has been issued against him),” the statement reads “She informed the press.
Sanvicente, according to Fajardo, cannot be detained without a warrant because the time limit for doing so has passed.
Under the Rules of Court, a warrantless arrest may be made when the person to be arrested has committed, is actually committing, or is attempting to commit an offense in the presence of the policeman; when an offense has just been committed and the arresting person has probable cause to believe, based on personal knowledge of facts or circumstances, that the person to be arrested has committed it; or when the person to be arrested is a prisoner who has escaped from a pena; or when the person to be arrested is
