The ARTA has rescinded its decision on the automatic approval of two NTC applications.
MANILA, Philippines — The Anti-Red Tape Authority (ARTA) has issued resolutions overturning its decision on the National Telecommunications Commission’s automatic approval of NOW Telecom and News and Entertainment Network Corp.’s applications (NTC).
The decision on the applications of NOWTel and NEWS Net will now be in the hands of the NTC, according to separate resolutions given by the ARTA officer-in-charge Ernesto Perez.
Following a judgment by the Office of the Secretary of Justice that transactions in quasi-judicial agencies are not covered by the 3-7-20 rule, the ARTA drafted the resolutions.
“(T)he relevant ARTA Resolution and Order of Automatic Approval dated March 1, 2021 are hereby set aside, and the application of NOWTel for the assignment of frequencies is hereby endorsed to the National Telecommunications Commission for expeditious adjudication,” the NOWTel case resolution stated.
Its Feb. 12, 2020 judgment of automatic approval for NEWS Net was also overturned, and the application was forwarded to the NTC for “early disposition.”
The ease of doing business (EODB) law requires all national government agencies and local government units to process simple transactions in three days, difficult transactions in seven days, and highly technical transactions in twenty days.
Depending on the intricacy of the transaction, transactions with complete requirements will be deemed accepted in three, seven, or twenty days.
