A religious organization’s plea to the Court of Appeals (CA) to stop the destruction of its property in Antipolo City was rejected.

The application for reconsideration submitted by The Bible Holiness Church of God of the Philippines, Inc., represented by Sister Noemi Luzan Esteban, was refused by the appellate court in a decision dated August 17 and written by Associate Justice Carlito B. Calpatura.

The court said that the organization “did not present any fresh and substantial ground” to overturn its Sept. 6, 2021 decision, which in turn upheld the Antipolo Regional Trial Court’s order to demolish its properties in a lawsuit brought by Sta. Lucia Realty & Development, Inc.

The church was ordered to be demolished after the developer allegedly claimed it would not give up a 6,313 square meter area of its property in Barangay Inarawan, Antipolo City, where it had previously been permitted to remain in the interim with other parties.

As a result of a deed of sale between Diosdado Luzan Jr. and Deogenes O. Rodriguez, who are both complainants in a lawsuit before the Department of Agrarian Reform Adjudication Board, the church asserted ownership in the meanwhile.

The lower court hearing the matter issued a writ of demolition in favor of Sta. Lucia during the subsequent lawsuit.
