PNP to ICC: Uphold Philippine sovereignty and the legal system

The International Criminal Court (ICC) was urged by the Philippine National Police (PNP) to respect the nation’s sovereignty and recognize the strength of its judicial system Monday.

After the ICC approved a probe into the nation’s anti-drug campaign under the government of former President Rodrigo Duterte, PNP chief Gen. Rodolfo Azurin Jr. made this statement.

“The PNP has always argued that the Philippines has an effective criminal justice system that is working, with ongoing judicial proceedings and remedies available to address any claims of human rights abuses in the government’s anti-illegal drug campaign. This is demonstrated by ongoing investigations into all drug-related fatalities and cases of government employees who were successfully prosecuted for participating in connected crimes, Azurin told reporters during a press conference at Camp Crame.

He asserted that the PNP is actively addressing the nation’s drug problem as well as internal discipline concerns in the police force through the handling of administrative matters by the PNP Internal Affairs Service (IAS) and drug charges brought in court against drug personalities.

In evaluating cases involving police employees found responsible for violations of police operational protocols in anti-illegal drugs operations, Azurin stated that they are completely collaborating with the Department of Justice (DOJ).

“Our case reviews of our drug operations from 2016 to date continue, and yes we had been providing also the DOJ, especially during the time of Chief PNP (Guillermo) Eleazar, we submitted I think over 300 case folders of which 52 cases have been completed that is a case against our PNP operatives pertaining to their drug operations so don’t see any reason why the ICC would come in to investigate because our police are still conducting joint investigations with the DOJ,” he said.

In order to evaluate “the scope and implications of the deferral request” made by the Philippine government, the International Criminal Court (ICC) halted its investigation into the alleged crimes against humanity connected to Duterte’s drug war in November 2021.

The ICC Pre-Trial Chamber (PTC) made the announcement on January 26 that it had decided to grant prosecutor Karim Khan’s request to carry with his investigation into “the Situation of the Republic of the Philippines.”

Before calling the ICC’s action “unreasonable,” DOJ Secretary Jesus Crispin Remulla emphasized that the department opposes “antics that tend to undermine our sovereignty and our standing as a sovereign country.”

The PTC stated that it is “not pleased” with the Philippines’ efforts to carry out pertinent inquiries “that would justify a deferral of the Court’s investigations on the basis of the complementarity principle.”

Meanwhile, Azurin reported that from January 1 to January 26, PNP agents detained 4,858 drug suspects and confiscated illegal substances valued at PHP273.8 million.

He claimed that 158 people detained for possessing these illegal firearms also had 601 stray firearms taken away by police.

350 weapons were delivered to police units for storage over the same time frame.

In addition, tracker teams from PNP units claimed to have located 2,275 wanted individuals during the course of a weeklong police operation from January 21 to January 29.

Among those detained are 1,837 additional wanted individuals for criminal charges and 438 of the most wanted.
