False charges of child abuse versus the protection of teachers

As long as they are using their authority to discipline students within the confines of the law, good morals, good customs, and public order, teachers should be protected from threats of false and malicious claims of child abuse, according to a senator who made the statement on Monday.

Representative Marissa Magsino of the OFW party-list claimed during a hearing of the House Committee on Basic Education and Culture that some teachers and school employees have become vulnerable to online attacks and malicious and false accusations even when they carry out their duties in accordance with the law.

She stated, “Unfortunately when our teachers and school staff carry out their responsibility to punish our pupils within their power, they are subject to complaints from the parents and scorn from the public.

If they are worried about losing their jobs or having their reputations damaged, she continued, “These attacks essentially prevent them from carrying out their responsibilities in full.

The committee has charged a technical working group (TWG) with consolidating and enhancing the suggested actions for institutionalizing support systems for public school teachers and staff in terms of student behavior and classroom management.

The plan aims to put into practice the classroom management standards created by the Department of Education (DepEd), which will be applied to all teaching and non-teaching staff in all public schools who have direct contact with pupils while carrying out their jobs.

“The prevalence of problematic and disruptive student behavior in schools has called attention to the need to train our educators to effectively manage their classes through appropriate discipline strategies to promote the student’s sense of responsibility in the classroom and to produce more responsible citizens,” Magsino said.

According to Magsino, the bill intends to shield instructors from being continually defeated by legal lawsuits that would not only be financially, mentally, and emotionally taxing, but would also obstruct pupils’ ability to study because teachers would be too busy with these cases.

The teachers must get training and professional development in child behavior and psychology, classroom management strategies, positive discipline, and other related areas connected to student discipline and classroom management.
