A denied certificate of candidacy may be appealed by BSKE bettors.

Candidates who had their Certificates of Candidacy (COCs) denied by the Comelec local office during the Barangay and Sangguniang Kabataan Elections (BSKE) may still appeal the decision to Comelec.

George Garcia, the chair of the Comelec, stated in a radio interview that they are prepared to rule on such issues if they are brought before them.

They are welcome to challenge the Comelec’s ruling by coming to us, he said.

The head of the election authority continued, “We will reinstate their name as a candidate when we see there is something wrong with the decision.”

He also gave his word that all cases will be decided before the end of October and that they would do so right away.

Our commitment is that we must settle matters by October 30 in order to demonstrate whether they should be accepted or rejected. Additionally, if we uphold it, they are free to file in a higher court if they so choose, he added.

“A solution to the problem is required by October 30. Their identities will not be listed if it is not settled, but that is obviously unfair. Therefore, a solution must be found before October 30,” Garcia continued.

The Comelec already declared that it would not accept COCs from candidates for non-resident barangays and SK bets who are beyond the age limit.

Aspirants from villages who are over 24 years old and do not now reside in the communities they wish to head would not have their COCs accepted, it was stated.

The filing window is scheduled to run from August 28 through September 2, 2023.

Republic Act 10742 stipulates that in order to run in the SK elections, a candidate must be a Filipino citizen, a registered SK voter, a resident of the barangay for at least a year prior to the election, at least 18 years old but not older than 24 on election day, literate, and not related within the second civil degree of consanguinity or affinity to any elected national official currently in office or to any incumbent local official.

Candidates for the barangay office must be Filipino citizens, registered voters in the barangay where they plan to run, and residents there for at least a year prior to the election day. They also need to be literate and have reached the age of eighteen on election day.
