Parties in the Marcos DQ lawsuits have until January 9 to file memoranda.
The Commission on Elections (Comelec) has granted the parties involved in the two disqualification lawsuits brought against presidential candidate Ferdinand “Bong Bong” Marcos Jr. 48 hours to file their memoranda.
Petitioners Bonifacio Ilagan, Akbayan, and Marcos were instructed by Presiding Commissioner Rowena Guanzon to submit their memoranda by electronic mail (e-mail) on Sunday.
“Lawyers have 48 hours from the date of this notice to file their memorandum.” Your 48-hour period begins at 12 p.m. today (Friday). You must submit the memorandum via email. Then there’s the hard copy the next day. During the conference, lawyers Jake Rey Fajardo and Antonio Salvador represented Akbayan and Ilagan, respectively.
Meanwhile, Marcos was defended in both instances by attorney Hanna Barcena.
Petitioners were given time during the preliminary meeting to specify what was on their petitions, which seek to exclude Marcos from competing in next year’s elections due to his conviction for not paying taxes.
Commissioner Aimee Ferolino was also present.
Marcos, on the other hand, apologized to the poll body, notably to Guanzon, through one of his closest friends, former congressman Anton Lagdameo, for any trouble caused by his failure to attend the precursor to the disposition of the cases.
He was unable to attend the meeting because he is under quarantine after being exposed to the coronavirus by his chief of staff, lawyer Vic Rodriguez, and his security escort, who both tested positive.
Benedict Francis Valdecanas, the former senator’s attending physician, submitted a medical certificate stating that the former senator had trouble speaking due to a terribly clogged throat and a fever.
“Upon my examination, Marcos had a temperature of 37.8 degrees Celsius and his throat was hyperemic and swollen,” said part of the doctor’s medical certificate, which was presented in full in court at the preliminary hearing before the Comelec.
Meanwhile, Akbayan voiced confidence in the former senator’s case.
“Our petition is about the truth, as well as Mr. Marcos’ responsibility for breaking the law.” We have a strong case, and the facts will finally reveal Marcos’ unsuitability for public service. In a statement, Akbayan’s First Nominee Percival Cendaa remarked, “We applaud Commissioner Guanzon and the members of the Comelec for the way they conducted today’s proceedings.”
Marcos should be barred from this year’s elections, according to the petitioners, because he was convicted of failing to file his income tax returns from 1982 to 1985.
They went on to say that a conviction carries the additional penalty of a lifetime ban from holding public office. Marcos was convicted guilty of tax evasion by the Quezon City Regional Trial Court (RTC) in July 1995.
After no counsel for the petitioner arrived at the conference, the third disqualification case brought by Abubakar Mangelen was submitted for resolution.
