In Cebu, Ilocos Sur, the PRRD issues ordinances establishing heritage zones.

President Rodrigo Roa Duterte has signed two bills into law designating heritage zones in Cebu and Ilocos Sur provinces.

On January 14, 2022, Duterte signed Republic Act 11644, also known as the “Carcar City Heritage Zone Act,” and Republic Act 11645, which establishes a heritage zone inside the municipality of San Vicente, Ilocos Sur.

The Constitution “mandates the State to protect, develop, promote, and disseminate the nation’s historical and cultural assets and resources, as well as its artistic creations,” according to Duterte, who signed RA 11644.

All of the country’s artistic and historic richness “constitutes the nation’s cultural treasures and shall be protected by the State, which may control its disposition,” according to the Constitution.

“To this end, in the development and management of its tourism industry, cultural heritage, and resources, the promotion and preservation of cultural and historical landmarks that highlight the uniqueness and beauty of Carcar City, including all century-old architecturally significant and historic houses thereat, shall be pursued,” read RA 11644.

The Department of Tourism (DOT), in collaboration with the provincial government of Cebu, the city government of Carcar, the National Commission for Culture and the Arts (NCCA) and its affiliated cultural agencies, and other concerned government agencies, will give Carcar City priority development under the law, subject to the rules and regulations governing the conservation and preservation of heritage zones.

The DOT will immediately prepare a development plan involving the preservation, conservation, restoration, and maintenance of cultural and historical sites and structures for the enhancement and sustainability of tourism in Carcar City, in collaboration with the local governments of Cebu and Carcar City, the NCCA and its affiliated cultural agencies, and the Department of Environment and Natural Resources (DENR).

The NCCA will only authorize methods and materials for conservation and restoration work that strictly comply with recognized international conservation standards, as specified in Section 15 of RA 10066, the National Cultural Heritage Act.

In conjunction with the DENR, the provisions of Republic Act 7586, or the National Integrated Protected Areas System Act of 1992, as revised by Republic Act 11038, shall be applied in the management of protected areas within the City of Carcar.

The DOT will establish the appropriate rules and regulations for the proper execution of this Act in collaboration with the Provincial Government of Cebu, the City Government of Carcar, the NCCA and its affiliated cultural institutions, and the DENR.

The Act, which began in the House of Representatives, was passed by the House on December 17, 2019, was revised by the Senate on September 27, 2021, and the House agreed to the revisions on November 23, 2021.

According to RA 11645, the DOT will immediately prepare a development plan involving the preservation, conservation, restoration, and maintenance of cultural and historical sites and structures for the enhancement and sustainability of tourism in San Vincente, Ilocos Sur, in collaboration with the Province of Ilocos Sur, the Municipality of San Vicente, Ilocos Sur, and the NCCA and its affiliated cultural agencies.

Only those methods and materials will be approved by the NCCA for conservation and restoration work that strictly comply with recognized international conservation standards, as specified in Section 15 of RA 10066.

The Municipality of San Vicente, Ilocos Sur will pass a municipal ordinance within one year of the Act’s effective date to operationalize appropriately the management of its heritage zone, including all cultural properties designated as intrinsic thereto, in accordance with the development plan and in accordance with the objectives and provisions of RA 10066 and RA 11645.

The NCCA and its affiliated cultural agencies, as well as the DOT and its attached agencies, will give priority development attention, assistance, and funding to the preservation, protection, study, and promotion of the cultural and historical integrity of the geographical area represented by the heritage zone, subject to existing appropriate government rules and regulations.
