Solon suggests more responsibility for commercial vehicle accidents.

It is necessary to boost liability insurance coverage for commercial vehicles to lessen the pain of victims and their families, particularly when there are fatalities.

Rep. Wilbert Lee of the Agri Party-List urged his colleagues to support House Bill (HB) 8498, or An Act Increasing the Compulsory Third Party Liability Insurance (CTPLI) for Commercial Vehicles and Total Indemnity Claim for Death or Injury of Any Passenger, Third Party, or Pedestrian without the Necessity of Proving Fault of Negligence, to safeguard and fairly compensate victims of similar incidents.

“The news can inform us about these road tragedies, but they do not show how much families suffer because of these accidental deaths,” Lee stated in a news release on Sunday.

He recalled the tragedy of a motorcycle rider killed Wednesday morning along Edsa in Mandaluyong City after being struck by a truck and having his head severed.

The next day, the vehicle struck a passenger bus along the highway in Balaoan, La Union, killing the driver and injuring three others.

A trailer truck driver in the Quezon province lost control of his vehicle and plummeted into a gully on the same day, killing the two backhoes it was hauling.

“What’s painful here is that these families have already lost a loved one, and yet they will discover that the maximum amount they can recover under CTPLI and no-fault indemnity is PHP100,000,” lamented Lee.

The goal of HB 8498 is to raise the insurance claim amount for death or injury per accident to any passenger, third party, or pedestrian from PHP 15,000 to at least PHP 1 million for any four-wheeled or more commercial motor vehicles designed to transport goods/cargoes and persons, with a gross vehicle weight (GVW) of up to 4,500 kilograms (kg); or PHP 2 million for any commercial motor vehicle designed to transport goods/ca

According to Lee, the quantity of insurance claims varies because the size of the commercial motor vehicle increases the risk of an accident.

HB 8498 further modifies the Insurance Code’s definition of “passenger” to include individuals who have not yet paid for or boarded a motor or motor vehicle as well as non-paying individuals who are specifically permitted to travel for free by the law or by the operator of the vehicle or his representatives.

The law expands the group of people who are eligible to make insurance claims to include pedestrians, people walking, and people in wheelchairs who are disabled and are near or on a roadway.

No amount of money, according to Lee, can save a person’s life, but if the measure is approved, accident victims and their families will receive enough compensation.
