On Monday, an overseas Filipino worker (OFW) party-list senator called for a study and evaluation of bilateral labor agreements (BLAs) that the Philippines had signed with countries of destination.
The review and assessment of these bilateral agreements, according to OFW Party-list Representative Marissa Magsino, are intended to ensure the protection of OFWs’ rights and welfare, particularly in situations involving abuse, maltreatment, and deprivation of life, as well as to ensure the availability of legal remedies in their support to ensure justice.
It is concerning that the majority of our BLAs lack explicit clauses addressing social security, equal treatment, repatriation, and—most importantly—procedures governing the investigation and prosecution of crimes committed against OFWs, as well as the legal remedies available to them and their families for redress of grievance and to ensure justice. It is imperative that we review and evaluate the content and efficacy of our BLAs in light of the recent atrocities committed against our OFWs, according to Magsino.
According to Magsino, a review of all labor agreements that the Philippines has signed with other nations will also reveal the precise rules and safeguards that must be put in place to protect the rights of OFWs, as well as the diplomatic measures and approaches that must be taken to ensure their inclusion in BLAs and strengthen their enforceability.
There are 25 BLAs between the Philippines and other countries of destination, including Kuwait, Qatar, the United Arab Emirates, and Italy, according to Magsino, who cited the Department of Foreign Affairs (DFA).
However, she pointed out that it doesn’t appear that the Philippines has binding BLAs with other significant and developing destination nations like Singapore, Hong Kong, Malaysia, Brunei, and Oman.
The “Migrant Workers and Overseas Filipinos Act,” she claimed, which stipulates that the State shall only permit the deployment of OFWs in nations where the Philippines has concluded a bilateral agreement or arrangement with the government of the receiving country on the protection of OFW rights, also emphasizes the significance of the nation entering into BLAs.
“Our bilateral labor agreements include the support provided to our OFWs when they are abroad in terms of policy. To ensure that there is no room for abuse of our OFWs, it must be determined and tenacious. According to her, if there are any violations, the agreements should outline severe penalties that would dissuade foreign employers from committing a similar offense.
She submitted House Resolution 743, requesting that the relevant House committee analyze and evaluate the current BLAs.
The 35-year-old domestic servant Jullebee Ranara was killed, and her burned body was discovered in a Kuwaiti desert in January. The resolution was brought forth in response to her death.
