House faces obstacles to a bill banning the “no permit, no exam” policy.

A bill that seeks to impose sanctions on private elementary and high school educational institutions by prohibiting students from taking scheduled periodic examinations because of unpaid financial obligations was approved on final reading by the House of Representatives on Monday with a resounding 259 votes.

The “No Permit, No Exam Prohibition Act,” also known as House Bill No. 7584, will permit students in private basic educational institutions to take scheduled periodic examinations despite not having paid their school fees as long as the unpaid debt is due to emergencies, force majeure (uncontrollable events), good cause, or other acceptable reasons.

The suggested proposal calls for learners’ parents or guardians to sign a promissory note for the settlement schedule before the exam to strike a balance between their needs and those of private institutions.

The measure also states that payment deferrals should not last past the school year unless specifically permitted by private basic education institutions.

Additionally, school administrators can refuse elementary and secondary students with unpaid debts the required clearance and transfer credentials they need to enroll in the next enrollment term until all prior delinquencies are satisfied.

According to its authority under Republic Act 9155 (Governance of Basic Education Act of 2001) and Batas Pambansa 232 (Education Act of 1982), the Department of Education (DepEd) may impose administrative sanctions on private basic education institutions that are found to have violated any provision of this Act.

Private schools may impose administrative and disciplinary punishments on parents, guardians, or students who use this law’s benefits in any way that constitutes fraud, false representation, or deception.
