
Restrictions on unvaccinated people are legal, although they are not permanent: DOJ
The government has enough justification to enact laws restricting the travel of those who have not been vaccinated against Covid-19.
On Tuesday, DOJ Secretary Menardo Guevarra stated that such procedures are only in force in locations where the warning level is high, not in areas where vaccines may be unavailable.
“These measures are time-limited and are not intended to be implemented in areas where vaccination rates are extremely low,” Guevarra said in a text message.
He further stressed that there are no travel limitations for anyone who hasn’t been vaccinated, only “restrictions on access to public transit or common carriers, subject to clearly stated exceptions.”
“More than three-quarters of those admitted to hospitals are unvaccinated, and more than three-quarters of those who die from Covid-19 are unvaccinated.” The unvaccinated are not prohibited from using public transportation if they have passes proving that they are out to obtain essential goods and services, such as food and medicine, or if they have medical certifications proving that they are unable to be vaccinated for medical or health reasons, according to Guevarra.
While public transportation is accessible to all, Guevarra stated that common carrier operators “are required to deliver their customers safely to their destinations, and safely means freedom not only from accidental injury but also from transmissible diseases.”
The DOJ chief further stated that Persida Rueda-Acosta, the head of the Public Attorney’s Office (PAO), is free to refuse vaccination because there is no law requiring inoculation against Covid-19.
In a Monday television interview, Acosta said she is having “second thoughts” about the vaccine and will wait for a protein-based vaccine that, according to the World Health Organization, uses harmless protein fragments or protein shells that mimic the Covid-19 virus to safely generate an immune response.
Virus vector vaccines, which use a harmless virus that does not cause disease but serves as a platform for producing coronavirus proteins to generate an immune response, or ribonucleic acid, which generates a protein that safely prompts an immunological response, are now in use.
“To that reason, PAO head Acosta is within his legal rights to withhold vaccination.” “However, the state has the authority to control the mobility of unvaccinated persons if it believes that such regulation is in the interest of public health or public safety and benefits both the vaccinated and the unvaccinated,” Guevarra explained.
He claims that someone who refuses to get vaccinated for personal reasons is “obliged to accept legitimate governmental restrictions affecting unvaccinated persons for the welfare of society as a whole.”
