The government is responsible for covering the overtime pay of the Bureau of Customs (BOC) workers stationed at airports since 2012.

BOC spokesperson Arnaldo dela Torre Jr. stated during a Laging Handa briefing that the bureau began compensating employees for working overtime after a Customs Administrative Order went into effect (CAO).

Since the adoption of Customs Administrative Order No. 7-2011, the Bureau of Customs is responsible for paying employees who provide services outside of normal business hours for overtime. The government is paying for this. Therefore, since 2012, the airline has not been responsible for payment, according to dela Torre, who is also the BOC operations chief.

The Supreme Court ruled last month that the BOC cannot bill airlines and other for-profit businesses for the overtime wages of its airport staff.

Charging such a fee to private companies is against Republic Act 10863, often known as the Customs Modernization and Tariff Act, according to Associate Justice Ricardo Rosario’s 14-page judgment.

The decision resulted from a case that the BOC Employees Association filed in 2013 asking the court to nullify administrative directives made by former commissioners Rufino Biazon and Cesar Purisima and the former finance secretary.
