On Wednesday, the Commission on Human Rights (CHR) declared its support for the reinstatement of divorce in the nation.

The CHR mentioned the passage of divorce legislation in a position paper, noting that House Bill Nos. 78, 2593, 3843, and 3885 and Senate Bill Nos. 147, 213, and 237 would recognize and defend the equal rights of women and men during and after divorce.

“Until marriage is annulled, it is still regarded as valid and continuing. Insanity, deception, duress, impotence, and serious and incurable sexually transmitted diseases are among the conditions that might lead to an annulment of a marriage, according to the commission, along with the absence of parental approval prior to marriage.

Legal separation provided certain conditions are met, allows a married couple to live apart without officially dissolving their union.

These include attempts by the respondent to coerce or induce the petitioner, a child in common with the petitioner, or a child of the petitioner; acts of repeated physical violence or grossly abusive behavior; acts of physical force or moral pressure to force the petitioner to change his or her political or religious beliefs; attempts by the respondent to corrupt or induce the petitioner, a child of the petitioner, or a common child; a final judgment that sentences the respondent to imprisonment for more than six years;

The CHR stressed that passing a divorce law will safeguard the rights of women and even men who are presently ensnared in violent and dysfunctional partnerships.

It stated that the divorce law will eliminate the negative aspects of legal separation and annulment and permit the parties to go on with their lives.
