Solon also wants the Official Gazette to publish laws online.
On Wednesday, Senator Jinggoy Estrada suggested that the Official Gazette and newspapers’ online editions should be included in the publication of all laws as a condition for their effectiveness.
As he emphasized the need to keep the execution of new laws, presidential issuances, and implementing rules and regulations (IRRs) up to date insofar as information distribution is concerned, Estrada brought up the proposed change to the Civil Code and Administrative Code of 1987.
In his view, higher efficiency may be attained if the public is adequately informed about new policies being implemented by the government due to the revolutionary influence of information technology that eliminated all communication barriers.
“Ignorance of the law is not an excuse, because in this information age dominated by the internet, information spreads swiftly and widely. “We must be aware of new technology to be more effective in disseminating information that has relevance to laws,” Estrada said. “Dapat makaagapay din tayo sa mga makabago, mabilis at mabisang pagpapalaganap ng impormasyon sa publiko na may kinalaman sa mga ipinatutupad na batas.”
Estrada introduced Senate Bill 1645, also known as “An act providing for the inclusion of publication of laws in the online version of the Official Gazette and of newspapers of general circulation among the legal and recognized format and channel of publication of laws of the country,” in January to address the Official Gazette’s scant readership and inconsistent publication schedule.
In the same bill, it was also suggested that if a freshly signed law was meant to address a national emergency, its publication requirements may be changed.
After being published in the Official Gazette or a national newspaper with a broad distribution for 15 days, laws become enforceable. All laws passed by Congress, presidential issuances such as decrees, proclamations, circulars, etc., and the implementing rules and regulations (IRRs) of laws must be published in order to be in compliance with due process.
