Following a temporary halt in December, the Department of Labor and Employment (DOLE) has resumed inspections to guarantee establishments’ compliance with the regulations.

Secretary Silvestre Bello III issued Administrative Order No. 11, series of 2022 on January 19, authorizing routine and complaint inspections, occupational safety and health standards investigations, and special inspections until December 31, 2022, unless canceled earlier.

Bello also directed the regional directors to provide the necessary power to check and probe specific establishments or workplaces, according to a press statement issued on Sunday.

Meanwhile, 126 technical safety inspectors have been given the authority to inspect boilers, pressure vessels, internal combustion engines, elevators, hoisting equipment, electrical wiring, and other mechanical equipment installations.

Technical safety inspectors were also instructed to undertake an initial study and evaluation of mechanical and electrical designs prior to issuing a permit to operate for mechanical equipment and a certificate of electrical inspection for electrical wiring projects.

Technical safety inspectors are trained and accredited mechanical and electrical engineers.

Only designated hearing officers will conduct required conferences for inspections with identified infractions, according to the rule.

After the rectification period has expired, a total of 485 hearing officers may hold required conferences for violations of general labor standards, occupational safety and health standards, and contracting or subcontracting laws.

Another 115 regional office employees have been named sheriffs, and they will be responsible for enforcing issued writs of execution, implementing decisions, and carrying out final decisions and directives.

Bello asked all regional directors to temporarily halt labor inspection activities in December in order for the Department to finalize all pending labor standards cases and plan the inspection program for 2022.

In 2021, a total of 90,327 establishments with 3.7 million employees were inspected.
