Commissioners Rowena Guanzon and Aimee Ferolino of the Commission on Elections (Comelec) spat barbs over the result of the disqualification proceedings filed against presidential candidate Ferdinand “Bongbong” Marcos Jr.

Ferolino requested Comelec Chairman Sheriff Abas in a letter dated January 28 to evaluate Guanzon’s appearances on television and social media, claiming that “her passion and zeal have taken over her that she may have forgotten the sub judice rule.”

In response to Guanzon’s allegations that Ferolino was “deliberately” delaying the release of the resolution on the consolidated cases against Marcos Jr., Ferolino said the ponente, or person tasked with writing the resolution, had been chastised by Guanzon, who is the presiding commissioner of the Comelec’s 1st Division, which is handling the disqualification cases against Marcos Jr.

On Saturday, Guanzon released a document dated January 28 on her social media account, demanding Ferolino to react to the postponement by “not later than 31 January 2022, 12 noon, as to why you have postponed the release of your ponencia.” “In order to ensure strict conformity.”

Ferolino’s office has had the cases for more than two weeks, she claimed.

“Given that I am retiring on February 2, 2022, I can only conclude that you are intentionally postponing the release of your ponencia until after my retirement in order to defeat my vote.” “In this way, my Separate Opinion will not be linked to the Majority Resolution or become part of the records,” she wrote in the memo.

Guanzon, on the other hand, tried to sway Ferolino’s decision, according to her letter to Abas.

“To be honest, Chair, it wasn’t just the promulgation date that she imposed on me. She also had a habit of telling me that I should accept her viewpoint. Commissioner Guanzon’s ability to prepare an opinion when the Ponencia has not yet submitted the resolution and all the case records are in my possession is shocking,” she wrote in a three-page letter.

“She even produced a Memorandum including her distinct opinion on a yet-to-be-released resolution.” To legitimize her demands, the Presiding Commissioner of the First Division is placing the cart before the horse.”

The 15-day deadline for issuing a resolution on the matter only applies to a single case, according to Ferolino, who added that the same deadline cannot be applied to aggregated cases like the one involving the former senator.

“Why to rush when this Commission decides cases on the merits, not for publicity or to accommodate and please anyone or anybody,” she wrote in her letter, adding that the case should be treated the same as any other case before the Commission, with resolutions carefully studied, reviewed, and considered.

“I stress that my office is well within the limits and the bounds of the rules in addressing the Marcos matter,” she stated.

Guanzon’s public disclosure as the ponente in the Marcos case, according to Ferolino, will expose her to probable pressure from various individuals and organizations, posing a threat to her life and security.

Guanzon said on Thursday that she voted to exclude Marcos from running for president in 2022 due to his refusal to file income tax filings, among other things.
