
The House of Representatives is pushing for a separate institution for high-level offenders.
The House of Representatives adopted a bill creating a separate detention facility for high-level criminals on third and final reading on Wednesday.
House Bill 10355, also known as the planned “Separate Facility for High-Level Offenders Act,” received 222 votes in favor.
The bill stipulates that a separate, secure, and sanitary penitentiary be built and maintained for the custody and safekeeping of high-level criminals serving sentences in the BuCor’s jail facilities.
According to the bill, high-level offenders are those who have been convicted of heinous crimes and have been identified as high-risk or high-profile by the Director General of the Bureau of Corrections (BuCor), based on the offense for which the inmate was convicted, the inmate’s criminal record or history, and affiliations.
The high-level offenders’ separate facility must be created in a suitable site selected by the Secretary of Justice, away from the general population and other detainees, and preferably within a military establishment or on an island distinct from the mainland.
The facility must be situated in a safe and secluded location to prevent unwelcome contact or communication from outside the prison institution.
High-level criminals must be housed in at least three distinct facilities, one each in Luzon, Visayas, and Mindanao.
Within 30 days of the completion of the building of such facilities, high-level offenders presently serving their sentences will be transferred.
The high-level offender facility will be a cutting-edge facility with surveillance cameras and the newest information technology and security systems capable of monitoring inmates 24 hours a day, as well as increased and extensive security features on locks, doors, and the institution’s perimeters.
At all times, the facility must be kept clean and habitable. Toilets and shower spaces must be sanitary and hygienic, and they must be maintained.
Only under the criteria and circumstances proposed by the Director General of the BuCor and approved by the Secretary of Justice are high-level criminals allowed to speak with their relatives or legal counsel.
An internal inspection by the prison administration and an external inspection by the Department of Justice shall be conducted on a regular basis to ensure that the institution is administered in accordance with the Constitution and other applicable laws and regulations, and that the penal system’s objectives are met.
