The Supreme Court has approved a law that will make it easier for refugees to become citizens.

MANILA, Philippines — The Supreme Court (SC) said on Wednesday that it has approved a rule to make naturalization easier for refugees and stateless people who have been recognized by the government.

The high court said in a statement that the tribunal approved A.M. No. 21-07-22 in its en banc meeting on Tuesday, which aims to simplify and reduce legal and procedural hurdles in obtaining Philippine citizenship in order to facilitate the assimilation and naturalization of refugees and stateless people into Philippine society.

The rule takes effect 15 days after it is published in two newspapers and governs the procedure for filing petitions for naturalization by refugees and stateless persons under the country’s international obligations, including the 1951 Refugee Convention, the 1967 Protocol Relating to the Status of Refugees, the 1954 Convention Relating to the Status of Stateless Persons, and the 1961 Convention on the Reduction of Stateless Persons.

Among other things, the new SC rule permits electronic publication.

If the court is satisfied that the petition is sufficient in form and substance, it may direct the clerk of court to cause the petition, excluding its annexes, to be published for three (3) weeks in the Official Gazette or its website, and in one newspaper of general circulation or its website in the place where the petitioner resides, or on the Supreme Court’s official website.

The law “gives proper consideration to the specific and vulnerable situations of refugees and stateless persons, such that alternate forms of publication would lower the necessary expenses and be less expensive for them,” according to the Supreme Court.

The rule also allows an unaccompanied child to have a petition for naturalization filed on their behalf by the Department of Social Welfare and Development (DSWD), the appropriate Local Social Welfare and Development Office (LSWDO) where the unaccompanied kid resides, or a child-caring agency.
