MANILA, Philippines – The Sandiganbayan has convicted a lawyer for the Presidential Commission on Good Government (PCGG) of receiving double compensation in violation of the Anti-Graft and Corrupt Practices Act 19 years ago.

Virgilio Ocaya was sentenced to up to eight years in prison and ordered to repay the PCGG PHP129,600 he received as double compensation from January to June 2003.

Ocaya worked for the PCGG while concurrently serving as the Metropolitan Waterworks and Sewerage System Regulatory Office’s (MWSS-RO) Deputy Administrator for Administration and Legal Affairs from September 2002 to June 30, 2003.

Ocaya received PHP278,388 per year from the MWSS and was paid PHP24,000 per month as PCGG legal counsel on a full-time basis from 2002 to 2003.

“(T)he Constitution and applicable law prohibit concurrent employment and compensation. As a result of this prohibition, the compensation the accused received from the PCGG was unauthorized or unjustified,” the March 18 decision stated.

The accused countered that he accepted employment with the PCGG “in good faith, believing that his position in the MWSS-RO was not a public office and that he received no public funds.”

The court noted that when Ocaya applied for PCGG employment, he was not receiving a salary or other benefits from the MWSS-RO and required additional income to meet his family’s needs and his wife’s medical expenses.

“However, his source of income was restored when he was reinstated as Deputy Administrator for Administration and Legal Affairs in January 2003, and he should not have accepted additional employment with the PCGG,” the court stated.
