The UNHCR applauds the Supreme Court’s simplified refugee case guidelines.

MANILA, Philippines โ€” The Supreme Court (SC) promised swift action and fairness in cases involving refugees and stateless people under its newly approved regulations.

Chief Justice Alexander Gesmundo informed visiting United Nations High Commissioner for Refugees (UNHCR) dignitaries that every matter that reaches the Supreme Court will be dealt with “full liberality.”

“Historically, the Philippines has been hospitable of refugees,” Gesmundo said during a meeting with the UNHCR group, which included Aurvasi Patel, lawyer Maria Ermina Valdeavilla-Gallardo, and Maria Louella Gamboa, UNHCR-Philippines senior protection associate.

Patel praised the SC guidelines, calling them “a terrific showcase,” and stating that the Philippine judiciary “stands out” as a result of the rules’ recent promulgation.

“Thank you so much for everything you’ve done for us. During the discussion, Patel said, “It’s a fantastic illustration of progressive thinking.”

On its website, the UNHCR praised the Philippines’ welcoming nature, citing the country’s open-door immigration policy in 1934, when President Manuel L. Quezon assisted Jewish refugees from Nazi persecution by providing sanctuary.

Gesmundo talked about the laws that were approved on February 15 that simplified procedures and eliminated legal and procedural barriers.

The rules, according to the Supreme Court en banc, demonstrate the Philippines’ commitment to international law, particularly the 1951 Refugee Convention, 1967 Protocol Relating to the Status of Refugees, 1954 Convention Relating to the Status of Stateless Persons, and 1961 Convention on the Reduction of Statelessness.

Among other things, the new SC regulations allow for electronic publication.

Section 12 directs the Clerk of Court to cause the petition, excluding its annexes, to be published for three consecutive weeks in the Official Gazette or its website; in one newspaper of general circulation or its website; or in the SC official website, if the court is satisfied that the petition is sufficient in form and substance.

The law “gives proper consideration to the specific and vulnerable situations of refugees and stateless persons, such that alternate forms of publication would minimize the necessary expenses and be less expensive for them,” according to the Supreme Court.

The rule also allows an unaccompanied child to have a naturalization petition filed on his or her behalf by the Department of Social Welfare and Development, the appropriate Local Social Welfare and Development Office where the unaccompanied child resides, or the caring agency that has custody of the child.

The new rules make the judiciary’s goal of “providing economical and effective methods of obtaining justice” a reality by proposing judicial reforms or streamlining court procedures to ensure efficient, fair, and timely delivery of justice, according to the Supreme Court. (
